FRANCIS X. DEE was admitted to the bars of the states of New York, New Jersey and Pennsylvania, the United States Supreme Court, the United States Courts of Appeals for the First, Second, Third, Fourth, Sixth, Seventh, Eighth and Ninth Circuits, the United States District Courts for the District of New Jersey and the Southern, Northern, Western and Eastern Districts of New York; the United States District Court for the District of Colorado and the United States District Courts for the Eastern, Middle and Western Districts of Pennsylvania and the U.S. District Court for the Eastern District of Michigan.
NATURE OF PRACTICE:
Mr. Dee had a wide ranging experience in his field - labor law and employment litigation. Prior to joining Carpenter, Bennett & Morrissey, predecessor to McElroy, Deutsch, Mulvaney & Carpenter, LLP, he was labor counsel to Litton Industries and a trial attorney for the National Labor Relations Board, Region 22.
In his employment practice, Mr. Dee represented corporations in cases alleging wrongful discharge, discrimination, sexual harassment, breach of express and implied contract, and related claims of defamation, negligence, tortious interference, false imprisonment and the like. He conducted OSHA litigation, ERISA and other benefits litigation, and provides WARN Act and Family Leave Act counsel. Mr. Dee tried numerous jury cases to conclusion. He also negotiated numerous labor contracts and represented employers before the NLRB and other agencies. He tried NLRB cases before administrative judges. His labor practice also included labor injunctions and wage & hour matters. In his OSHA work, Mr. Dee defended employers in cases involving death, burns, and amputations. He also handled non-compete litigation and serves as local counsel on patent litigation. He represented employers in many industries, including pharmaceuticals, manufacturing, telecommunications, transportation, financial services, maritime and shipping.
He was experienced in managing class action litigation, including nationwide classes, pertaining to various benefits and employment issues. He handled FLSA collective actions, as well as other wage and hour issues.
Mr. Dee had significant appellate experience. He handled appeals before the various United States Courts of Appeals throughout the United States, the New Jersey Supreme Court and intermediate appellate courts.
He arbitrated numerous cases before AAA, JAMS, NJ Board of Mediation, FMCS and FINRA.
