Jeffrey Bernstein

JEFFREY BERNSTEINs practice concentration is in the areas of creditors' rights in bankruptcy, representation of bankruptcy trustees and bankruptcy litigation. He has represented secured and unsecured creditors, insurers, sureties and purchasers of debtor assets in bankruptcy matters and in related proceedings primarily in New Jersey, New York and Delaware.  

Mr. Bernstein received his Bachelor of Arts degree, cum laude, from Yeshiva University in 1978, and his M.B.A., with distinction, from the New York Institute of Technology in 1983. Mr. Bernstein is a 1988 graduate of Benjamin N. Cardozo Law School, cum laude, where he served as Notes and Comments Editor of the Cardozo Arts and Entertainment Law Journal.

He was admitted to the bars of the State of New Jersey and the United States District Court for the District of New Jersey in 1988, the State of New York in 1989, the United States Supreme Court in 1992, the United States Court of Appeals for the Third Circuit and the United States District Courts for the Eastern and Southern Districts of New York in 1994 and the Northern and Western Districts of New York in 2015.

Mr. Bernstein has regularly spoken on panels on bankruptcy topics in New Jersey and New York.  He is also the Senior Advisor of the McElroy Deutsch Bankruptcy Blog.

He is a member of multiple McElroy Deutsch’s committees, including, the Diversity and Inclusion Committee, Pro Bono Committee, and the Mentorship Committee. 

Mr. Bernstein is a member of the New Jersey State Bar Association and its Creditor Debtor Section as well as its Diversity Committee, the New York State Bar Association and its Diversity and Inclusion Committee, the American Bar Association, Business Law Committee and the American Bankruptcy Institute. He is also Assistant Executive Director of the Bankruptcy American Inn of Court in New Jersey. Mr. Bernstein has previously served as Chair of the District VA (Essex County – Newark) Fee Arbitration Committee and has previously served on the District VA (Essex County – Newark) Ethics Committee as a committee investigator and prosecutor.  In 2020, he was appointed Secretary of the Bankruptcy Law Section of the New Jersey State Bar Association.
