Leonardo Tamburello - Of Counsel
LEONARDO TAMBURELLO is Of Counsel at McElroy, Deutsch, Mulvaney & Carpenter, LLP. Following graduation from Rutgers School of Law – Newark, he served as the Law Secretary from 1997-1998 in the Superior Court of New Jersey, Appellate Division to the Honorable Donald G. Collester, Jr.
For more than a decade, Mr. Tamburello has focused his practice in the healthcare field before both State and Federal courts. He has been lead trial counsel in a fraud case before the Law Division and argued before trial and appellate courts resulting in reported opinions from New Jersey courts, including the Appellate Division and Supreme Court of New Jersey.
Mr. Tamburello has defended physicians against many different claims of medical malpractice including alleged lack of informed consent; the supposed failure to properly assess an orthopedic surgical patient for anticoagulant therapy; and the claim that an emergency department physician discriminated against and failed to properly treat a patient.
He has been deeply involved in numerous contested matters concerning alleged overpayment, fraud and insurance fraud arising from provider billing practices and has also handled cases involving physician restrictive covenants.
Among his recent matters, he has successfully challenged, based upon physician-patient privacy laws, subpoenas from the U.S. Attorney’s Office issued to providers; led an internal self-audit of a hospital’s Medicaid billing and reimbursement practices and negotiated overpayment resolutions with payers. He provides counsel related the Medicare and Medicaid programs, HIPAA, the Affordable Care Act and other laws and regulations that shape the modern healthcare practice.
Non-provider matters have included the representation of corporations in litigated shareholder disputes, general commercial litigation and other areas of professional liability defense.
Mr. Tamburello has lectured concerning compliance, professionalism and healthcare matters before the New Jersey Institute for Continuing Legal Education, Seton Hall University School of Law, hospital staff and administration, and other groups. He has published articles in medical and legal journals on health care, business strategies for physicians, evolving compliance trends and tort liability.
He is a member of the New Jersey State Bar Association, the Morris County Bar Association, the American Health Lawyers’ Association and the New Jersey Chapter of the Healthcare Management Financial Management Administration.
Mr. Tamburello has been recognized by peer selection and independent research as a “Rising Star” from 2006 through 2012 by New Jersey Monthly Magazine.
To benefit the Wounded Warrior Foundation, Mr. Tamburello recently completed the 2011 Tri-State Tough Mudder, a 12-mile obstacle course that includes hazards created by water, mud, fire and electrified wire. He is planning a 2012 repeat performance.
