Charles T. Kane - Partner

CHARLES T. KANE practices in the areas of complex commercial transactions and litigation with an emphasis on representing owners, general contractors, subcontractors, renewable energy firms, designers, and manufacturers of building products.  Mr. Kane has significant experience with the review, negotiation, and drafting of all types of procurement and services contracts, including construction management, EPC, EPCM, GMP, cost-plus, subcontractor, and design agreements. Mr. Kane routinely assists clients in the implementation of contracts to ensure compliance with terms and conditions, laws, and applicable regulations. Mr. Kane’s practice also includes providing advice and guidance to clients on the preparation and analysis of bid proposals.  Mr. Kane has significant experience in the area of commercial transactions governed by the Uniform Commercial Code, labor and employment, non-compete agreements, trade secrets, as well as all aspects of real estate financing, leasing, development and management.

Mr. Kane regularly prosecutes and defends claims in various Federal and State courts, as well as arbitration tribunals involving all aspects of the design, procurement and construction of infrastructure.  He has achieved significant results for his clients in construction claims associated with delay and productivity losses, disputed change orders, payment entitlements, design issues, trade stacking and bid protests.  Mr. Kane also has experience with matters governed by an array of environmental programs.

In addition to his experience at the firm, Mr. Kane also served as seconded counsel to a Fortune 400 energy company and public utility.  In this role he negotiated, drafted, amended, and managed agreements with contractors, subcontractors and vendors including: purchase and sale agreements; engineering, procurement, and construction agreements; engineering, procurement, and construction management agreements; construction management agreements; joint development agreements as well as various agreements to obtain specific services and materials.  Mr. Kane assisted the regulatory department in the review and implementation of regulations including FERC 1000.  In this position, Mr. Kane also served as counsel on a half-billion dollar combined-cycle power plant construction project handling all legal aspects of the project both transactional and claims related.
