John Zen Jackson - Partner

JOHN ZEN JACKSON is a Fellow of the American College of Trial Lawyers and a Partner at McElroy, Deutsch, Mulvaney & Carpenter, LLP.  Following law school he began his legal career as law secretary to Richard J. Hughes, Chief Justice of the New Jersey Supreme Court.  He was then a litigation associate at Shanley & Fisher in Newark until leaving to start his own practice.  He became a partner at MDMC in July 2011 with the firm’s expansion of its healthcare practice with the lawyers from the boutique healthcare practice of Kalison, McBride, Jackson & Robertson joining the firm.  Mr. Jackson’s healthcare practice has emphasized litigated matters in judicial and administrative forums.

Regularly trying jury cases to a verdict, Mr. Jackson became certified by the New Jersey Supreme Court as a civil trial attorney in 1985 and has been repeatedly recertified since that time.  He served on the Supreme Court’s Civil Certification Committee for many years and was chair of the Committee and a member of the Board on Attorney Certification between 2008 and 2011.  Mr. Jackson has handled professional licensure and hospital privilege disputes before State administrative bodies and hospital credentialing committees as well as judicial review through the New Jersey Supreme Court.  He has experience as a hearing officer for hospital privilege disputes.

Mr. Jackson has handled a variety of commercial litigation issues as well as the defense of qui tam actions under the Federal False Claims Act and insurance coverage and insurance fraud cases. Besides trying many individual medical liability cases for a variety of health care providers, he was lead defense counsel for New Jersey plastic surgeons sued in connection with the silicone gel breast implant litigation and has been involved in a number of mass tort litigation programs for medical devices or health care products, including pedicle screws, diet drugs, and Rezulin. 

In addition to trial advocacy, he is an experienced appellate litigator. He was defense counsel in the New Jersey Supreme Court cases limiting the liability of physicians for suspected exposure to the HIV-virus and for alleged lack of informed consent regarding abortion procedures. Mr. Jackson has served as amicus counsel for the Medical Society of New Jersey, the American Medical Association, and the New Jersey Hospital Association in appellate matters before the New Jersey Supreme Court and Appellate Division.  He has been involved in numerous reported opinions.

Mr. Jackson has over 50 published articles in medical and legal publications on health care, tort liability, and trial technique topics.  He has been a member of the Editorial Board of MDAdvisor, a peer-reviewed journal for the New Jersey medical community, since its inception in 2007.

He is a member and served as President of the Trial Attorneys of New Jersey (1999-2000). Mr. Jackson is also a member of the New Jersey State Bar Association (Health and Hospital Law Section; Civil Trial Bar Section), and the Mercer County Bar Association. He is a member of the Defense Research Institute (Medical Liability and Health Care Committee; Drug and Medical Device Committee; Trial Tactics and Techniques Committee), the American Bar Association, and the American Health Lawyers Association.

He is admitted to practice in New Jersey, New York, and the District of Columbia and to practice before the United States District Courts for the District of New Jersey, the Southern District of New York, the District of Columbia, the United States Court of Appeals for the Third Circuit and the Supreme Court of the United States.

Mr. Jackson has an AV Peer Review rating from Martindale-Hubbell.
