Kevin MacGillivray - Partner

KEVIN MACGILLIVRAY is a 1993 graduate of Seton Hall University, where he obtained a B.A. in Communications.  Mr. MacGillivray graduated from Seton Hall University School of Law in 1998, where he obtained a Juris Doctorate, cum laude.  He is admitted to the bars of the State of New Jersey and the United States District Court, District of New Jersey.  Mr. MacGillivray served as judicial clerk for the Honorable Wilfred P. Diana and the Honorable Victor Ashrafi in the Superior Court of New Jersey, Civil Division, Somerset County, for the 1998-1999 Term.

Mr. MacGillivray has extensive experience counseling and representing insurers in matters involving complex coverage claims under a multitude of coverage types and programs, including general liability insurance, products-completed operations insurance, umbrella/excess insurance, first party property insurance, environmental claims insurance, employment practices liability insurance, errors and omissions insurance, professional liability insurance, builders risk and wrap-up insurance, directors and officers insurance, commercial automobile and truckers liability insurance, cyber risk insurance, and cargo insurance.  Mr. MacGillivray has represented insurers in state and federal courts in complex declaratory judgment actions, bad faith litigation, and fraud litigation.  Mr. MacGillivray’s experience also includes counseling and representing insurers in complex claims involving “personal and advertising injury” coverage under primary and umbrella/excess insurance policies, including coverage claims involving copyright infringement, trade dress infringement, trademark infringement, defamation, disparagement, invasion of privacy, cyber risks, and false advertising.   Mr. MacGillivray also represents clients in product liability litigation, commercial litigation, environmental defense litigation, and construction defect litigation.

Mr. MacGillivray has participated in the presentation of seminars to national and international insurance and reinsurance companies on topics including: coverage issues arising out of the Motor Carrier Coverage Form and Truckers Liability Coverage Form; disclaimers, reservation of rights and non-waiver agreements; additional insured coverage issues and contractual indemnification; captive insurance companies; cyber risks and cyber liability insurance issues; global warming claims; and class action trends in the United States.
