Environmental

MDM&C's Environmental Team has broad-based experience resulting from decades of handling complex environmental litigation, administrative proceedings and transactions for clients of all sizes, ranging from closely-held to Fortune 500 companies, in virtually every sector of the economy, from manufacturing, chemicals, utilities, real estate development and construction. The Environmental Team counsels clients in the full range of environmental matters, including site remediation, air, water, natural resources, hazardous waste, toxic torts and permitting. We work closely with the firm’s corporate, real estate, land use, construction, finance and other practice areas to ensure that environmental issues that arise in mergers and acquisitions, real estate, construction projects, bankruptcy, financing and other key transactions are addressed. We have handled substantial matters across the entire Northeastern region, including Connecticut, Massachusetts, New Jersey, New York, Pennsylvania, and Delaware. 

Our experience also includes representing clients in environmental and toxic tort litigation, penalty and enforcement matters, natural resource damage claims and permitting and compliance controversies concerning both state and federal statutes and regulations, including CERCLA, RCRA, ISRA, the Underground Storage Tank Act, the Spill Compensation and Control Act, the Federal and State Wetlands Acts, TSCA, and the Air Pollution Control Act; and we aid numerous lending institutions in assessing environmental risks associated with financing arrangements and in developing risk assessment policies. We have handled many matters in connection with the licensed site remediation professional programs in Massachusetts and New Jersey and we have spoken extensively on the New Jersey Site Remediation Reform Act, which has already and continues to change dramatically the site remediation process in New Jersey. We also assist clients in complying with the myriad of OSHA standards and handling OSHA investigations and enforcement matters.

The Environmental Team is mindful of finding practical solutions to our clients’ problems. By way of example, we have extensive experience in pursuing brownfield and other redevelopment incentives and, given the technical background of our attorneys, we can work with our clients’ consultants to identify cost effective alternatives to environmental problems.

Our lawyers serve on numerous federal and state bar association committees, as well as commercial and industrial organizations, that focus on environmental and environmental-related issues.
