Overview
PETER E. HENRY has been engaged in private practice in New Jersey since his admission to the bar in 1968. His practice is concentrated in the areas of real estate, land use planning and zoning, commercial real property investment, development and financing. He is a member of the Morris County, New Jersey State, and American Bar Associations. He participates in the Real Property, Probate and Trust Law Section and the Section of Corporation, Banking and Business Law of the American Bar Association. He is also a member of the Real Property, Probate and Trust Law Section, as well as the Land Use Law Section of the New Jersey State Bar Association.
In the public sector, Mr. Henry served for decades as the attorney for the Far Hills Borough Board of Adjustment and Planning Board, the Branchburg Township Board of Adjustment, the Mendham Borough Planning Board, the Mendham Borough Historic Preservation Commission, and the Mountain Lakes Planning Board.
He has also represented numerous private clients in zoning and other land use applications before Planning Boards, Boards of Adjustment, and municipal governing bodies. Representative clients over the years have included McDonald’s Corporation, Star Enterprise (Texaco) [now Shell], Dunkin’ Donuts, as well as numerous small businesses and individuals as owners, users or developers/investors in real property. The range of applications which Mr. Henry has handled have included major and minor subdivisions, site plan approvals and all types of variance applications. In addition, litigation related to zoning matters, including appellate review of the actions of local agencies, has been part of his practice.
Mr. Henry’s experience in the zoning and planning field has included residential development, commercial, office and flex space projects, retail stores, gas stations, restaurants, and banks (free-standing and in shopping center context). Applications have been prosecuted in municipalities ranging from the highly developed northeast corner of the State through the central and western portions of the State.
Finally, in the areas of general real estate law as well as land use law counseling, Mr. Henry’s experience ranges from transactional matters involving conveyancing, commercial leasing and real estate financing to organization and structuring of investment or development venture entities, to litigation involving title issues and condemnations.
