William N. Aumenta
Overview
WILLIAM N. AUMENTA graduated from Richard Stockton College of New Jersey in 1997. He is a 2000 graduate of Widener University School of Law, where he was a member of the Delaware Journal of Corporate Law. While in law school, he served as a clerk to The Honorable William B. Chandler, III, of the Delaware Court of Chancery, and he was certified as a mediator by the Philadelphia Municipal Court in small claims and landlord-tenancy matters. He was also the recipient of the 1998 Faculty Award. Mr. Aumenta was admitted to the bars of the States of New Jersey and New York in 2001, and the Commonwealth of Pennsylvania in 2014. Following law school, he served as judicial law clerk to The Honorable Theodore Z. Davis, P.J.Ch., of the New Jersey Superior Court, Chancery Division, General Equity Part.
Mr. Aumenta has extensive experience in the areas of commercial litigation, probate litigation, chancery practice, telecommunications, creditor's rights, banking, and residential and non-residential default servicing. He currently focuses his practice in the areas of commercial and business litigation, contract disputes, professional liability defense (attorneys), telecommunications, and residential and non-residential default-servicing in which he represents secured lenders, mortgage servicers and investors in all aspects of contested and uncontested foreclosures, defensive litigation, creditor's rights, and title insurance claims and litigation. Mr. Aumenta also has experience representing clients in environmental litigation matters.
Mr. Aumenta is a member of the Justice Morris Pashman Inn of Court, American Bar Association, New Jersey Bar Association, New York County Lawyers Association, Bergen County Bar Association, and Union County Bar Association. • Successfully obtained summary judgment on behalf of lending and mortgage servicer clients in numerous contested residential and non-residential foreclosures in New Jersey and New York, involving issues related to standing, statutory violations, fraud and misrepresentation, and predatory lending, among many others.
• Successfully represented lending and mortgage servicer clients in the defense of numerous claims, assessments, fines, and other violations issued by public bodies, including the New York Environmental Control Board.
• Successfully represented a national banking association in obtaining summary judgment dismissing a borrower’s predatory lending claims related to a $3.575 million loan.
• Obtained summary judgment dismissing a borrower’s multi-million dollar claim for damages stemming from the alleged bad faith refusal to fund under complex construction loan instruments.
• Successfully litigated and upheld the validity of a client’s telecommunications leasehold interest valued in excess of $1 million where the defendant lessor argued that the lease was void ab initio due to its failure to comply with the New Jersey public bidding statute in leasing its land.
• Successfully represented a lessor under four wireless license agreements in obtaining a substantial monetary judgment and having the defendant’s $32.5 million counterclaim dismissed in its entirety.
• Successfully dismissed a plaintiff’s claims that a wireless telecommunications facility operator violated certain deed restrictions relating to the transmission of cellular signals.
• Successfully dismissed multiple actions by plaintiffs who asserted claims for damages stemming from personal injuries sustained on the client’s wireless communications facility.
