Overview

DOUGLAS M. POULIN  is a partner in the firm’s Hartford office where he focuses his practice on construction, commercial litigation and insurance coverage matters. He has advised clients in a wide variety of complex construction, insurance and commercial disputes and has been a member of the firm’s Construction Group since 1999.  Mr. Poulin represents both plaintiffs and defendants in disputes involving construction and design matters, surety law, insurance coverage, business relationships, business torts and OSHA regulations. His clients have included domestic and multinational corporations, insurers and individuals.

Attorney Poulin’s experience includes defending an EPC contractor in an arbitration in London, England before an LCIA panel in a claim involving alleged construction defects in a 550 MW offshore wind farm; defending insurers from fidelity bond and liability claims; rendering coverage opinions; defending a contractor in an administrative hearing from OSHA citations arising from an employee’s fatal injuries suffered on a construction project in Hawaii; defending owners/developers from claims of construction and design defects in common interest communities; prosecuting claims for professional liability insurance coverage arising from the construction of a forty story office building in New Jersey; representing towns and municipalities in prosecuting claims arising from the alleged misdesign and defective construction of public buildings;  and drafting construction contracts on behalf of owners, general contractors and subcontractors.

Attorney Poulin serves as a director of the Connecticut Building Congress and has written and spoken extensively on issues of concern to the construction industry.

  • Defense and prosecution of construction claims on behalf of general contractors, subcontractors, sureties and owners arising from a variety of construction projects including commercial, industrial, residential and marine.
  • Successfully prosecuted and settled delay claim brought by international curtainwall contractor against general contractor and owner.
  • Successfully defended, both at trial and on appeal, international contractor from OSHA citations issued after worker’s death.
  • Counsel to EPC contractor in defense of over $50 million in claims arising from renovations to coal fired power plant.
  • Favorably settled numerous asbestos and silicosis exposure claims for personal injuries brought against general contractor by employees of subcontractors.
  • Successfully defended concrete panel manufacturer in suit involving negligent design and construction of a Puget Sound seawall.
  • Statewide trial experience in construction disputes.
  • Won Plaintiff’s verdict in two-week jury trial of accounting malpractice claims.
  • Successfully prosecuted claims of negligence and breach of fiduciary duty brought against directors and officers of a failed bank who were engaged in abusive and preferential insider lending.
  • Obtained summary judgment on behalf of a Connecticut bank that was being sued by former customer who had raised multi-million dollar lender liability claims.
  • Extensive experience in contract disputes, drafting and negotiations.
