Rory M. Farrell

Overview

RORY M. FARRELL is a Partner with the Hartford office of McElroy Deutsch, whose practice is focused on the resolution of construction disputes and construction-related surety claims in federal court, state court, arbitration and mediation. Mr. Farrell’s practice includes counseling construction managers, general contractors, subcontractors, design professionals and sureties on a wide range of issues arising from the construction industry.  

In his litigation practice, Mr. Farrell represents sureties, contractors, subcontractors, design professionals and owners in connection with all aspects of litigation including, but not limited to, performance and payment bond litigation, mechanic’s liens, contract claims, construction defects, design defects, and claims for delay, interferences, loss of productivity and differing site conditions.

Mr. Farrell is a member of the American Bar Association's Forum on Construction Law and is a contributing author to numerous construction publications, including the Connecticut Bar Association’s annual Construction Law Summary and numerous publications concerning the construction industry.

Prior to joining the firm, Mr. Farrell clerked for the Hon. Douglas S. Lavine at the Connecticut Appellate Court.  He is admitted to practice law in Connecticut, Massachusetts, and Rhode Island including the U.S. District Courts of Connecticut, Massachusetts, and Rhode Island and the U.S. Court of Appeals for the Second Circuit.

  • Successfully defended a construction manager on a school construction project in Massachusetts against claims for delay and unapproved change orders brought by a structural steel subcontractor and numerous finish trades.
  • Obtained dismissal of a subcontractor’s claims against a general contractor on the basis of pay-if-paid defense in connection with a large private construction project located in Fairfield County.
  • Successfully represented a general contractor against a developer in connection with an $8 million renovation project located in Fairfield County.
  • Represented a remediation contractor in dispute with a general contractor on a $117.5 million remediation project which included work in nine states.
